Buffalo Wild Wings' legal team has pointed to a past Ohio Supreme Court case to support their defense. They argue that a similar case has already settled the issue at hand, providing a legal precedent in their favor.

The legal battle stems from a class action lawsuit filed by Aimen Halim in March 2023 against Buffalo Wild Wings. Halim's lawsuit alleges that the chain's boneless wings, primarily composed of chicken breast, are misleadingly marketed. The plaintiff's legal team contends that these boneless wings more closely resemble chicken nuggets than traditional chicken wings.

Legal Maneuvers and Defense

Buffalo Wild Wings initially sought to dismiss the case in June 2023 and subsequently bolstered their defense in a filing on July 29. Citing the Berkheimer v. REKM LLC case, the chain's attorneys argue that consumers should reasonably anticipate certain ingredients in food items, thereby absolving restaurants of liability.

Interpretation of Labeling

The Ohio Supreme Court's ruling in the Berkheimer case emphasized that terms like 'boneless wings' are descriptive of the cooking method rather than a guarantee of bone absence. The court highlighted the importance of consumer understanding, likening the term to 'chicken fingers,' where no actual fingers are served.

Continued Legal Battle

Despite the legal complexities, Halim's legal team maintains their stance, emphasizing the distinction between consumer expectations related to boneless wings and the actual meat composition. Buffalo Wild Wings has yet to provide a public comment on the ongoing lawsuit.
