According to a lawsuit, Elon Musk told an investor in a conversation at 4 am that his company would only rent its office "over his death body" if he died.
On Tuesday, six former Twitter employees filed a lawsuit against Musk and X. Corp., Twitter's holding firm, at the District Court of Delaware.
The lawsuit primarily alleges that Twitter did not pay severance payments to its former employees, and accuses defendants of 14 counts, including fraud, labor laws, and contract breach.
In the past few months, Twitter landlords from London, New York and San Francisco all filed lawsuits against the company because it failed to pay rent. The lawsuit filed on Tuesday includes a new section that details internal discussions about the apparent non-payments.
According to the lawsuit, Musk told Joseph Killian (a plaintiff who was employed at Twitter for twelve years and was responsible for office design) that Twitter no longer paid rent in December last year.
According to the lawsuit, Mendoza relayed that message to Musk. He is a venture-capitalist who has invested with Musk. Mendoza was hired to help bring to life the billionaire's vision of Twitter 2.0.
The suit states that "Killian tried to convince Musk via Mendoza of the dangers of Musk's position that no rent will be paid at all, pointing out any attempt to negotiate the terms of Twitter’s many leases was doomed to fail."
Mendoza is said to have responded, "Elon told my he would pay rent only over his dead body." He said that the conversation took place at 4 am the next day.
Musk said on CNBC that he sleeps six to seven hours every night. He previously told BBC he "shot himself in the foot" for tweeting past 3 am.
According to the lawsuit, Alex Spiro (Musk's lawyer) "loudly stated" that it was unreasonable to expect Twitter to pay rent to its landlords because San Francisco is "a shithole."
Insider's Sawdah Bhaimiya reported recently that Twitter's HQ is only a few minutes' walk away from the Tenderloin District, which is often cited by the media as the epicenter for the homelessness crisis.
Musk described downtown San Francisco as "a derelict, zombie-apocalypse" on Tuesday. He is still insistent that his employees can't work from home.
