Elon Musk's Attempt to Cherry-Pick Information from Nannies
Grimes has accused Elon Musk of blocking their kids' nannies from providing information that would help her in their custody battle and instead cherry-picking information that is favorable to him, according to court records obtained by Business Insider.
The Custody Battle in Texas and California
Musk and Grimes both filed child custody lawsuits against each other in September, with Musk arguing that Texas is the kids' home state and accusing Grimes, whose legal name is Claire Boucher, of moving two of the children to California to avoid Texas courts. Grimes, on the other hand, claimed that the children have been living in California since around December 31, 2022, with the exception of one child who has been with Musk in Texas.
Importance of Nannies' Testimony in Determining Child's Residence
The case's outcome could have significant implications for Musk, as Texas limits child custody payouts for three kids to $2,760 per month, while California has no cap. Testimony from nannies regarding the children's whereabouts is expected to play a crucial role in determining their residence.
Musk's Alleged Restriction of Nannies' Access
In a motion filed on November 30, Grimes accused Musk of limiting access to the kids' nannies, who are allegedly bound by non-disclosure agreements (NDAs) that Musk required them to sign. Grimes argued that Musk should relieve the nannies of their obligations under the terms of the NDAs if she seeks information from them that would be beneficial to her case. Additionally, Musk filed a motion to prevent Grimes from obtaining information from the company that employs the nannies.
Musk's Cherry-Picking of Nannies' Information
Grimes' filing claims that Musk wants to cherry-pick information from the nannies that he believes is favorable to him. It further suggests that Musk takes the position that the nannies are not bound by the NDAs when it benefits him, but uses the same NDAs to block the nannies from providing Grimes with information.
Legal Experts' Views on Nannies' Testimony
Legal experts believe it is unlikely that Musk can prevent the nannies from testifying without dropping the case altogether. The nannies are considered key witnesses, as they have knowledge of how many days the children have spent in various locations. The court is expected to compel the nannies to testify in the custody battle, despite potential loyalty to Musk and the risk of being sued by him.
Non-Disclosure Agreements and Court Proceedings
A non-disclosure agreement typically prohibits the public disclosure of information about a family but does not prevent nannies from speaking in court. Musk has requested a protective order to restrict public access to the custody case, citing the potential risk to his children.
Sanctions and Financial Penalties
Grimes has requested the court to sanction Musk for his actions. However, legal experts suggest that imposing a financial penalty is unlikely and is usually seen as a last resort.
