ByteDance Allegedly Violated OpenAI's Terms of Service
ByteDance, the parent company of popular social media platform TikTok, has been accused of using OpenAI's technology to develop its own language model, according to a report by The Verge. This move not only raises eyebrows in the Artificial Intelligence industry but also violates OpenAI's terms of service.
OpenAI's terms explicitly state that customers are not allowed to develop AI models that compete with OpenAI's products and services. Additionally, they are prohibited from extracting data from the services in any way other than through the permitted APIs (Application Programming Interfaces). These APIs enable developers to create their own applications using OpenAI's GPT (Generative Pre-trained Transformer) technology.
ByteDance's Actions and Internal Communications
The Verge report reveals that ByteDance was aware of these terms but still used OpenAI's API to train and compare its own model, known as Project Seed. Internal communications from the Chinese company instructing employees to mask the evidence using "data desensitization" techniques were also viewed by The Verge. Although ByteDance eventually instructed employees to stop using the API for Project Seed development, it appears that the API was still used to assess the performance of ByteDance's own chatbot.
OpenAI's Response and Suspension of ByteDance's Account
OpenAI confirmed that it has suspended ByteDance's account due to the breach of its terms of service. In a statement to The Verge, OpenAI spokesperson Niko Felix emphasized the importance of adhering to usage policies to ensure the responsible use of their technology. While ByteDance's use of OpenAI's API was minimal, OpenAI will conduct further investigations and ask for necessary changes or terminate the account if policy violations are discovered.
ByteDance's Denial and Clarification
ByteDance denied any wrongdoing and clarified that it was licensed to use OpenAI's GPT APIs. A spokesperson for ByteDance stated that they use GPT to power products and features in non-China markets, but they utilize their own self-developed model, Doubao, exclusively in China.
OpenAI's Lack of Response
Business Insider reached out to OpenAI for comment, but the company did not immediately respond.
ByteDance Expanding into the AI Market
ByteDance is actively expanding its presence in the AI market. It was recently reported that the company is developing a chatbot-building competitor to OpenAI's customizable ChatGPT bots. This move further solidifies ByteDance's commitment to AI innovation.

Over the past year, US regulators and lawmakers have closely scrutinized ByteDance due to concerns that user data collected from TikTok could be handed over to the Chinese government. These concerns have raised questions about the security and privacy of user information on the platform.
